Builder Registration in Victoria – Domestic Builder Manager (DBM) VBA updates
BUILDER REGISTRATION IN VICTORIA
If you have a Builder Registration DBM Domestic Builder Manager Registration with the Victorian Building Authority then this is seriously going to affect you and your building projects.
DBM practitioners will not be able to enter into new major domestic building contracts after 30 September 2021.
As you already know, from the 30th June 2022 the Registration Class of Domestic Builder – Manager (DB-M) is being stopped but the real changes to the DBM Registration start now! Yes, as of the 30th September 2021 you will not be able to enter into a major domestic Building Contract which means… no new Building jobs!
If you do commence a building Contract after this date, then you risk facing fines and disciplinary actions for working as a building practitioner under these circumstances.
The VBA have contacted all DBM Registered Builders which means that you should be looking to apply for Domestic Builder Unlimited (DBU) Builder Registration or DBM’s licence class will not be able to carry out work in the capacity as Registered person in the industry.
Your Relevant Building Surveyor hands are tied! If your Major Domestic Building Contract was entered into before 30th September 2021 then you will be issued a
Building Permit however the RBS cannot issue you a Building Permit from this date if you are a DBM.
BUILDER LICENCE VICTORIA
These changes have been made which are set to have a direct impact on you as DBM. The phasing out of the Domestic Builder Manager (DBM) and Domestic Builder Unlimited condition 40 (DBU-40) class of Builder Registration applies to both individuals and companies. Under the new laws the DBM or DB-U40 registration will discontinue after 30 June 2022.
Project Manager (Domestic) is the new class of registration to replace DBM Registration and comes under what the VBA call a ‘person responsible for a building project’. It should be stated from the outset, that like the DBM, you cannot carry out domestic building work yourself, or use unregistered persons to carry out the work.
However, this is where the similarities end. The practitioner holding Project Manager Domestic Registration cannot enter into a major domestic building contract and Relevant Building Surveyors cannot issue Building Permits. This is worth giving serious thought to whether Project Manager Domestic Licence is right for because if you want to continue or have the ability to build, do client work, build for yourself or sign contracts with clients then this Builder Registration is not for you.
NEXT STEPS FOR YOUR BUILDER REGISTRATION
If you are DBM then you can no longer take on a Domestic Building Contract. You have until 2022 to apply for Domestic Builder Unlimited Registration to continue to build or risk not being able to do domestic Building projects at all. As a DBM you can continue to build until 30th June 2022 only if you’ve entered into a Domestic Building Contract before 30th September 2021.
